How can an Orange Park Child Support Attorney Help Me?

The Florida Child Support Guidelines provide a formula for determining the amount on parent will pay the other as their reasonable share of the cost of food, housing, and medical treatment.

The only factors that are considered by the child support guidelines are: (1) income of both parents, (2) allowable deductions, (3) day care expenses, and (4) children’s medical insurance. Monthly expenses such as mortgage, rent, utilities, food, car payment, insurance and clothing are NOT considered by the guidelines (and therefore, not considered by the judge).

If a parent is not working (or not fully employed), the court may “impute” income to that person. “Impute” means that the court will assign that parent an income for the purposes of calculating child support.

The allowable deductions to income are an important part of the child support calculation. Allowable deductions include: (1) federal, state and local income taxes, (2) child support paid for other children, (3) alimony paid in another case (4) the cost of your own medical insurance, and (5) union dues. Allowable deductions do not include garnishments or retirement plan contributions (unless they are mandatory).

The amount of a child support obligation can be affect by the amount of time a parent spends with a child. Recent revisions to the Florida Statutes allow a reduction in the child support amount when the parent paying child support spends over 20% of the nights with the child.
