If the relocation would be more than 50 miles, then the parent must comply with the provisions of Florida Statute 61.13001. The statute requires that the parent who wants to relocate provide the other parent with a Notice that contains the following information: (1) reason for relocation, (2) new address & contact information, and (3) proposed an amended parenting plan. The Notice should be provided a few months prior to the proposed relocation.
After the other parent receives the Notice, they have 30 days to file a response. If an objection is filed, a hearing will be required to determine if the relocation is in the best interest of the child.
